Research On The Safeguard Mechanism Of Seafarers' Rights And Interests

China is in the process of transforming from a large shipping country to a powerful shipping country.Being the most basic productive force of the shipping industry,seafarers compose the indispensable part of the world shipping industry.They have made tremendous contributions to the sustainable development of the shipping market,the expansion of foreign trade and the steady growth of social economy.However,due to the particularity of their profession,the labor and social security rights of seafarers have not receivedwidespread attention from society.Seafarers have been in a long-term weak position of the labor relationsbecause of the lack of protection mechanism and legal system for their rights and interests.On November 12,2016,? Maritime Labour Convention2006?came into force formally for our country,which makes it more urgent to improve the protection system of seafarers' rights and interests.Therefore,the study on the protection of seafarers' rights and interests conforms to the social development and has important theoretical and practical significance.Based on the current situation of the protection of seafarers' rights and interests in Zhejiang jurisdiction,this paper summarizes the current situation and basic practices and studies related issues of the protection of seafarers' rights and interests in China by combining the current legal system of our country,drawing lessons from the experience and practices of typical countries and using literature research,comparative analysis,case analysis and other methods.The content of the study can be summarized as three parts:first,analyzation of the main bodies of protection mechanism for the seafarers' rights and interests' and brief introduction of their function;Second,Thorough analysis of the current situation of the seafarers' rights and interests protection in Zhejiang jurisdiction and foundation of the existing problems and unreasonable points;Third,References of legislative system,mechanism operation and institutional guarantee from typical countries in the combination of international conventions.Finally,put forward recommendations aboutimprovingthe protection of the rights and interests of our seafarers from many aspects proceeding form our actual national conditions.
