In recent years,with the rapid development of e-commerce,the third-party payment,as a new means of payment,has been an important part of e-commerce.The third-party payment establishes a convenient,fast,efficient,low-cost way of capital transfer between the parties of the transaction,and effectively ease the pressure on the payment of electronic transactions.However,when the third-party payment brings convenience to us,it also hides the transaction risks and security risks and other issues.Our country's laws and regulations about the third-party payment are still missing.Compared with the rapid development of electronic commerce,it has lagged behind.Therefore,how to solve the civil legal problems existing in the third-party payment and protect the legitimate interests of the parties in the third party payment is important to the healthy development of e-commerce in China.This article starts from the overview of the third-party payment,discuss the civil legal problems of China's third-party payment,compare and analysis the legislative practice at home and abroad,and then put forward some ideas to perfect the third-party payment civil legal system of our country.Chapter one starts from the overview of the third-party payment in electronic commerce,mainly introducing the concept,classification and the civil legal relationship of the third-party payment.Chapter two mainly discusses the status quo of China's legislation of the third-party payment and the main civil legal problems of it.Firstly,this article introduces the current situation of the legislation of the third party payment in our country.Secondly,this article introduces the civil legal problems of the third-party payment in our country,including the legal ownership of client's reserves and its fruits,the protection of consumer's right and the distribution of civil liability of the third-party payment.Chapter three discusses the third-party payment legal system of other foreign countries.It mainly introduces the legislation and practical experience about the third-party payment of other foreign countries,and then draws inspiration from it.Chapter four discusses the proposal to solve the civil legal problems in the third-party payment of e-commerce in our country,including perfecting the civil legal system of the client 's reserves and its fruits,perfecting the legal system of protecting the rights and interests of consumers and perfecting the civil liability system of the third-party payment.
