Research On Prevention And Control Countermeasures Of The Crime Of Sexual Assault Against Children In China

Children are the flowers of the motherland,is the hope of the future.The sexual assault incident makes the childhood experience become a lingering nightmare for children.At present,the crime of sexual assault against children is in a high incidence in China,which seriously endangers the physical and mental health,and affects the sense of security of the people and the normal order of society.In order to understand the status of the crime of sexual assault against children objectively,the author combined the study with Chinese judicial documents network in 2015-2017 to refer to the sexual assault against children cases,with 1657 cases of received after screening,carrying on the statistical analysis,in hope of summarizing present situation and characteristics of crime of sexual assault against children,and combined with the current crime of sexual assault against children in legislative,judicial and social prevention and control of the status quo,this paper analyzes the reason of the crime of sexual assault against children and the existing problems,finally forward some countermeasures to improve the situation,to provide the prevention and control theory and the practice of reference.This paper is mainly divided into four parts:The first part is an overview of the crime of sexual assault against children.It mainly includes five aspects,including the definition of related concepts,the general situation of sexual assault crimes against children,the general situation of sexual assault crimes against children,the current situation and new characteristics of sexual assault crimes against children.First of all,it elaborates the legal provisions at home and abroad and the definition of the related concepts of child sexual assault crimes by Chinese scholars,and on this basis,defines the related concepts in this paper.Secondly,based on the special report on sexual assault crimes issued by the supreme people's court,the general situation of sexual assault crimes in China is grasped as a whole.Then,combined with the statistical report of the judicial case study group of Peking University magic weapon,it makes a preliminary interpretation of the overall situation of the crime of sexual assault against children in China.Finally,based on a sample of 1,657 cases of sexual assault against children collected from the Chinese judicial documents network,the paper analyzes and summarizes in detail the characteristics of the crime of sexual assault against children in China and the new characteristics of the current crime of sexual assault against children,so as to provide data support for the later research on the problems and causes in the prevention and control of sexual assault against children.The second part is the current situation of prevention and control of child sexual assault crimes in China.Respectively from the aspects such as legislation,form a complete set of perfect law legislation rules and regulations,set up specialized agencies,issued documents,to explore the working mechanism and the judicial practice of judicial relief,etc,and the government cooperation,under the participation,schools,social forces involved in efforts to social control,etc.,summarizes the present situation of our children's crime prevention and control of sexual abuse.The third part is the problems and causes of the prevention and control of child sexual assault crimes in China.The previous analysis of the characteristics and prevention and control status quo of child sexual assault crimes in China revealed the deficiencies and defects in the aspects of legislation and regulation,judicial practice,social control and individual factors of child sexual assault crimes in China,laying a foundation for the prevention and control countermeasures of child sexual assault crimes in the future.The fourth part is the prevention and control countermeasures of the crime of sexual assault against children in China.Draw lessons from foreign powerful measures,as well as Hong Kong,Taiwan area in our country from the build child sexual abuse prevention and control of criminal law guarantee system,perfecting the child sexual abuse prevention and control of criminal judicial protection system and improve the crime prevention and control of sexual abuse children social security system and so on three aspects discusses the prevention and control countermeasures of sexual abuse of children crime in our country,in order to effective crippling crimes against children,protect children's physical and mental health,maintain social stability.
