Study On The Law Of China's Sexual Assault Crime Against Children

With the development of society and the popularization of network,more and more cases of sexual assault against minors have been exposed by the media in recent years.In 2016,433 cases have been exposed in China,which does not include those unknown cases.Thus,the legal system of sexual assault against children in China urgently needs to be improved and perfected.As a vulnerable group,minors have limited ability to judge and identify sex,especially vulnerable to the temptation and deception of illegal elements,and then suffer sexual abuse.Children,as a special part of the minor group,may not only cause irreversible physical harm,but also psychological harm to children for life,which affects their future personality construction.More attention should be paid to it.However,the legislative content of the criminal law on sexual assault in our country takes care of the child group very little,and the judicial practice does not sufficiently reflect that it is more different from other victims of sexual assault.The crime of sexual assault on children is not reflected either in the prevention of sexual assault on children,or in the legal relief for the child victims after the incident.This point.Moreover,as far as the current research on the protection of minors' sexual rights in China is concerned,the group identification,scope of regulation and applicable penalties are not perfect enough.Therefore,in the study of sexual assault on minors,we should not only learn from the development experience of predecessors,but also from the locality of sexual assault on minors in China Sex starts.The research methods to be adopted in this paper are normative research,empirical analysis and comparative research.They analyze the legal defects of criminal law in punishing sexual assault against children and then put forward perfect opinions according to the actual situation.There are five aspects in the content division: the first part is the introduction part is to introduce the background and significance of this article,as well as the research status at home and abroad;the second part is the theoretical research situation of sexual assault children in China;the third part is the current situation and existing problems of sexual assault against children in China;the fourth part is the legislation at home and abroad on sexual crimes against children and its reference;the fifth part is the perfect countermeasures for the law of sexual assault against children;the sixth part is the conclusion part,in this paper,at the same time,we have a positive outlook on the future legal system.
