Investigation And Research On Crimes Of Destroying Environment And Resources Protection

With the rapid development of economy and society,the current environmental pollution and unreasonable use of resources lead to ecological imbalance,which has become a worldwide public hazard.Our government has been committed to the protection of the ecological environment,and in recent years has increased the intensity of protection.At the same time,criminal judicial means play an indispensable role in combating crimes against the protection of environmental resources.Public security organs are at the front of criminal judicial procedure.Due to the lack of sufficient theoretical guidance,there are still institutional deficiencies in the investigation of criminal cases of environmental resources protection,which need to be supplemented urgently.Based on the national conditions of our country and the domestic research results on this issue,this paper clarifies the necessity of investigating and studying the criminal cases of environmental resources protection.Starting with the concept of the crime of destroying environmental resources protection,this paper systematically analyses the related concepts of the crime of destroying environmental resources protection.In this paper,the crime of destroying the environment and resources protection refers to 14 specific charges that may be applicable in dealing with the crime of destroying the environment and resources protection.Criminal cases of environmental resources protection are characterized by strong administrative attributes,complex subject of crime,wide social impact,strong concealment of criminal activities,and complex crime location.Through the concrete analysis of the investigative subject,investigative methods,investigative measures and investigative strategies in dealing with crimes of damaging the environment and resources protection,this paper focuses on the analysis of the current situation of the investigation of such cases,and the particularity of the investigation of crimes against the protection of environmental resources;more importantly,from the perspective of policemen handling cases,this paper analyses the difficulties in investigating crimes that damage the environment and resources protection at the present stage,mainly from the professional investigation team construction strength is weak,the case clue source is few,the investigation and evidence collection difficult and the evidence standard is not unified several aspects to start the discussion.In view of the investigation predicament and the actual work,the following four countermeasures are put forward: firstly,we should improve the investigation quality of full-time police and equip them with scientific and technological testing equipment;secondly,we should strengthen the comprehensive social renovation efforts and expand the source of case clues;thirdly,we should improve the investigation mechanism and promote the effective link between administrative and criminal law enforcement;fourthly,we should improve the investigation cooperation.
