Research On The Legal Regulation Of Unfair Competition Behavior Of APP Operators

The Anti-Unfair Competition Law was amended on November 4,2017.The biggest change in this revision is to increase the corresponding regulatory provisions for unfair competition in the Internet field.This clause has made the corresponding cases of unfair competition in the Internet field have a corresponding basis.However,there are still some cases in the mobile internet that are deemed to be unfair competition behaviors.For these unfair competition behaviors appearing in the mobile Internet,the Anti-Unfair Competition Law does not provide for this,which may result in this targeting the Internet.The special clauses of unfair competition behavior lag behind reality at the beginning of the publication,and cannot satisfy the needs of real life situations and cannot play its practical role.By combing through the existing literature,it can be seen that most scholars focus on the unfair competition behavior of the Internet in the environment of the Internet and the mobile Internet.Few people study the unfair competition behavior of APP operators.Based on this situation,this paper combines the newly revised "Anti-Unfair Competition Law" from the specific perspective of APP operators to study its unfair competition behavior.This paper first defines the concept of APP and APP operators,then proposes the problem of unfair competition behavior of APP operators,and then analyzes the general clauses and Internet terms of China's "Anti-Unfair Competition Law",and the unfair competition behavior of APP operators.The form of expression and its particularity are discussed,and then according to the Internet provisions of the newly revised Anti-Unfair Competition Law and the relevant provisions of the Internet competition principle,combined with the special circumstances of the APP operator's unfair competition,the cause,the competent court,etc.The problem is to analyze the regulation of APP operators' unfair competition behavior.Through the analysis and research of the above problems,and finally based on the cases appearing in practice,the paper puts forward suggestions for improving the applicable entities,increasing the form of unfair competition,increasing the form of civil liability and identifying standards to improve the unfair competition of APP operators in China.
