Research On Legal Mechanism Of Compensation For Patent Pledge Financing

In recent years,with the country's emphasis on the industrialization of intellectual property rights,more and more science and technology enterprises have emerged,which has played a certain role in promoting the country's innovation and development.Under this circumstance,patent pledge financing has gradually entered the public's field of vision as a new type of pledge financing.However,because the patent right as an intangible property right and its own as a patent pledge,it has the characteristics of value instability,which leads to the risk of patent pledge financing.In order to overcome the risk of patent pledge financing,further promote the “knowledge change”,improve the financing dilemma of enterprises,and mobilize the enthusiasm of financial institutions to participate,the patent pledge financing risk compensation mechanism came into being,but due to the risk compensation of China's patent pledge financing The mechanism started late,and there are still some inadequacies such as imperfect legislation and unsound law enforcement system.Combining theory with practice,this paper mainly discusses the status quo and legal problems of the patent pledge financing risk compensation law mechanism.The main body is divided into four chapters.The first chapter is the theoretical basis of the patent pledge financing risk compensation.It mainly introduces the patent pledge based on the concept and characteristics of patent pledge financing and its differences with other pledge financing methods.The concept and theoretical basis of the financing risk compensation mechanism.The second chapter introduces the necessity of establishing and improving the legal mechanism of patent pledge financing risk compensation from two aspects: the risk of patent pledge financing and the value target of patent pledge financing risk compensation mechanism.The third chapter analyzes the problems existing in the current legal mechanism of patent pledge financing risk compensation from three aspects.The fourth chapter begins with the problems existing in the legal mechanism of patent pledge financing risk compensation described in the third chapter,and analyzes the legal path to improve the legal mechanism of patent pledge financing risk compensation.
