The Crime Of Medical Cosmetology In China Is A Qualitative Research

The development of medical cosmetology technology makes medical cosmetology more and more popular.However,it is worth noting that the rapid development of the medical and beauty industry has led to chaos within the industry and highlighted the hysteresis of the law.At rules constraint medical beauty industry mainly include "medical beauty services management method"(the ministry of health on May 1,2002)legal status is low,the academic research is mainly involved in the field of tort,in the face of dangers beauty when the object of the right to life and health and other major rights due to the absence of criminal law can't effective protection of the rights of beauty object.This paper intends to study the existing problems of crimes related to medical cosmetology and put forward corresponding countermeasures.This paper consists of the following five parts:The first part of our country medical cosmetology crime is outlined.This chapter interprets the concept and characteristics of the crime of medical cosmetology,clarifies what is the crime of medical cosmetology and its characteristics,and sorts out the content of the crime of medical cosmetology.The second part analyzes the current situation of medical cosmetology crimes in China.Through specific data and cases to explain the current situation of crimes in medical cosmetology in China,analyze the problems in the reality of crimes in medical cosmetology in China,explore the causes of the problems,and have a deeper understanding of crimes in the medical cosmetology industry.The third part of the overseas and Hong Kong and Taiwan areas of medical beauty crimes for the legislative review and reference.By investigating the legislative provisions of some countries in common law system,continental law system and Hong Kong and Taiwan region of China that have achieved a lot in the aspect of crime in medical beauty,this paper focuses on the analysis of the references for China,hoping to help the qualitative research on the crime in medical beauty in China.The fourth part is the qualitative analysis of the crimes related to medical cosmetology.This paper analyzes the necessity and feasibility of the crimes of medical cosmetology,which should not be confined to the field of civil tort,but should be restricted by the criminal law.The fifth part is the perfection of the crime of medical cosmetology in our country.Based on the above analysis of the different types of crimes in medical cosmetology,the author puts forward Suggestions on the regulation of criminal law according to different types of crimes in medical cosmetology,in order to better protect the important rights and interests of the beauty objects,such as the right to life and health,and to improve the disorder in the medical cosmetology industry.Focusing on crimes committed in medical cosmetology,this paper analyzes the nature of crimes committed in medical cosmetology and puts forward Suggestions for improvement,which is helpful for criminal law to better safeguard the basic rights and interests of beauty objects,and is expected to be beneficial to the development of medical cosmetology industry.
