Research On The Law Of Renewal Of The Residential Construction Land Use Right In China

Residence,which is quite valuable,is essential in people's daily life.Therefore,it was controversial because equivocal law of renewal of residential construction land use right in our country.This paper analyses some problems existing in the renewal of the residential construction land use right,including the unclear scope of applying for of the automatic renewal of the residential construction land use right,the ambiguity of expenses after the expiration of the term,the unclear requirements of the automatic renewal and the time limit after the renewal,the unclear of the procedures for the automatic renewal and so on.In the process of constructing the system of the renewal of the residential construction land use right in our country,in addition to the provisions of the Constitution of our country,we must follow the principle of seeking the truth from facts,making full use of the land and the principle of keeping the balance of interests.Putting forward some suggestions of the renewal on the scope,time limit,frequency,expenses and procedure to consummate the renewal of the residential construction land use right.The problems of the renewal of the residential construction land use right are related to the most basic living problems of Chinese residents.It is necessary to establish an operable renewal system of the residential construction land use right as early as possible,which is beneficial to promoting social progress and long-term stable development.
