The Realization Of Justice Under The Background Of Big Data

As a new information processing technology,big data has been popularized and promoted globally,showing a vigorous development trend.It has become a key factor to improve the core competitiveness and the new engine for the sustained and rapid growth of the information industry and drastically changed the social lifestyle of the public.The application of big data in the new era has become the main stream trend of social development in various industries and fields.In the field of law region,the rule of law time of big data has als?been approaching imperceptibly.In particular,the people's increasingly judicial needs have promoted the in-depth application of big data in the judicial field.As the"fuel" of basis of judicial work,judicial trial data(based on the in-depth mining and analysis of judicial big data)is playing an important role that cannot be ignored in the realization of judicial justice.Judicial big data is not only the "calibrator"for fair justice and judgment,but also a "barometer" observing development of economic society and a "guiding landmark" for promoting the process of intellectualization and legalization of social governance.However,everything has its two sides,and the application of big data in judicial activities is no exception.On the basis of integrating various data resources from judicial adjudication,human affairs and administration,the judicial system seeks for judicial rules through in-depth analysis so as to better guide the judicial trial practice process and improve the pertinence and effectiveness of the study and judgment of the case,enabling judges to respond more appropriately to new situations and problems arising in the process of trial,adj udication and execution of cases,and ultimately achieves the purpose of serving the people so as to serve the masses.However,every technology has its own advantages and disadvantages.In the application process of big data,there are cases of data falsification leakage,as well as hidden dangers of infringement on the judicial justice due to over-reliance of judicial staffs on big data,AI and system.Meanwhile,there is a legislative gap in big data internally.China has not yet established a complete specification and system of big data,nor fully explored the potential value of big data.The paper attempts to analyze the mechanism of big data on judicial justice from the multiple perspectives and the double function of "plus-minus" of big data to the realization of judicial justice,and explore an effective way to promote the realization of judicial justice with big data through the construction of Wisdom Judicature of which the principle is big data applying in judicial trial to promote judicial reform and accelerate the research and application of justice and big data,thus add to the building of Wisdom Judicature.
