Preventing and combating sexual assault is one of the hot topics of concern to all sectors of society.Sexual assault brings both physical and psychological harm to people,especially women and children.The amendment to the Criminal Law IX adds a "prohibition of employment”in one of the 37th articles.The purpose is to reduce the personal risk of the perpetrator and to avoid the infringement of social legal interests,which is of great significance in combating sexual assault.Shanghai Minhang,Zhejiang Cixi,Jiangsu Huai'an and other places have carried out pilots for the prohibition of sex offenders.On the one hand,the sexual assault criminals are prohibited from using the industry to prohibit the recidivism rate of sexual assault to a certain extent,and protect the vital interests of the people;on the other hand,because the"prohibition of employment" in the Criminal Law Amendment IX of China has only one provision,it is not made.Specific regulations,so there are still many problems,inevitably caused a lot of controversy.The purpose of this paper is to provide a reference for the prevention of sexual assault crimes by analysing the blind spots and lacks of the prohibition of sexual abuse in China.It can promote sexual assault crimes and the application of laws prohibited by the industry,and ultimately contribute to family harmony,social stability and the healthy development of minors.In addition to the introduction and conclusion.this article is divided into four chapters.The first chapter is the theoretical issue of the prohibition of sexual assault offenders in China.Through the understanding of sexual assault crimes and the prohibition of related concepts,the analysis of sexual assault crimes has a high proportion of acquaintances,high recidivism rate of sexual crimes,obvious tendency of victims to be younger,and high hidden crime rate of criminals..Exploring the provisions of the Criminal Law Amendment IX and the administrative regulations on the prohibition of employment,and then analyzing the current situation of the prohibition of sexual assault in China.The second chapter compares and analyzes the relevant systems prohibited by domestic and foreign employment.This paper analyzes the application of the prohibition system and the legal consequences of foreign countries with a system of prohibition of employment.The purpose is to explore the advantages and disadvantages of foreign institutions through the introduction of the foreign industry prohibition system.The employment prohibition system provides viable experience.The third chapter discusses the prohibition of the application of the practice of sexual assault offenders in China from the legal level and the implementation level.Sexual assault crimes show a high incidence,and it is imperative to apply the prohibition of employment.However,there are many problems at the same time.The discussion of the applicable problems of the system will help us analyze the reform direction that the sexually motivated criminals in China apply to the prohibition..The fourth chapter puts forward suggestions on the improvement of the prohibition system of employment from the two levels of law and implementation.Based on the advantages and disadvantages of the existing system of prohibition of employment,this paper proposes to refine the relevant legal system prohibited by the industry and improve the relevant implementation procedures prohibited by the industry,and hopes to provide a feasible reference for combating and reducing the rate of sexual assault.
