| Since the first enterprise engaged in P2P lending was established in China in 2007,there are 7503 P2 P network lending platforms in China by June 2018.In just over ten years,the P2 P industry has developed rapidly.From the beginning,it is unknown that the turnover of the P2 P industry has reached about 4 trillion RMB annually.At present,the pressure of economic downturn is increasing.When private investment is looking for new investment growth points,borrowers are also looking for more convenient loan channels for approval and more relaxed supervision,which has resulted in the prosperity and development of the P2 P industry.But it is precisely because of the lack of supervision and the rapid development of the industry,in order to pursue economic interests,illegal elements began to carry out illegal and criminal activities on the P2 P platform,and even used the P2 P platform as a tool for crime.As of June this year,there were more than 5,000 problematic P2 P platforms,accounting for more than 70% of the total number of platforms,which shows that the current crime problem in the P2 P industry is serious,and better for it.The investigation of crime cases on P2 P network platform has become a problem that must be studied at present.The author starts with the characteristics of the P2 P industry and the mode of criminal operation,then finds out the problems existing in the current investigation activities according to these criminal modes,deeply analyses the causes of these problems,and puts forward some countermeasures for how to solve these problems.The first chapter introduces the origin of P2 P network platform.On the one hand,it discusses the concept of P2 P network platform crime cases,the main charges involved in such crimes and the current criminal law regulation on them.On the other hand,it analyses the operation mode and characteristics of such crimes,combs the law of their crimes and reveals the essence of such crimes.Chapter 2 summarizes the current development status of the P2 P industry,and analyzes the reasons for the current situation of the industry,and briefly analyses the future development trend of the P2 P network platform industry.Chapter three analyses the problems existing in the investigation of this kind of cases at present,and carries out the analysis according to the procedural provisions of the investigation organs for handling the cases.First,the problem of unobstructed cooperation in the investigation of cases,mainly from the cooperation within the investigation organs,including the cooperation between the various departments within the public security organs and the public security organs in various places,and other departments besides the investigation organs.Difficulties in door collaboration are analyzed.The second is to analyze the problems existing in the process of investigating such cases from the following aspects: the ways of investigating crimes on P2 P network platform need to be refined,the difficulty of investigating crime scene across physical and virtual space,the difficulty of obtaining criminal evidence mainly from electronic data,the arrest of criminal suspects and the tracing of funds involved.Chapter IV is mainly based on the problems summarized above to further analyze and put forward the corresponding countermeasures,mainly from how to build case cooperation within and outside the public security organs to solve the problem of information collection in the process of investigation;refine the ways of investigation;improve the means of crime scene investigation,especially for the collection of electronic data,to improve the crime scene investigation of such cases.Investigation;from strengthening the positioning and tracking of criminals,timely seizure of property involved,actively pursuing stolen damages,timely seizure,seizure of property involved in the investigation,freezing the accounts involved to solve the tracking of suspects and property involved in these aspects put forward countermeasures and suggestions. |
