Research On Reduction Of Illegal Fund Raising Crime

In the new era of rapid economic development,financial crimes have gradually increased,especially the illegal fund-raising crimes.The state's efforts to combat illegal fund-raising crimes have also increased,but it has also highlighted certain problems under the situation of strict crackdown.Illegal fund-raising crimes have expanded application in judicial practice,which is not conducive to the protection of the legitimate rights and interests of small and medium-sized enterprises,and the healthy development of finance.The crime of illegal fund-raising is not a specific crime in China,but a kind of crime.Through the current criminal law and related judicial interpretations in China,it can be concluded that it includes the crime of illegally absorbing public deposits,the crime of fund-raising fraud,the crime of illegal business operation,the crime of false advertising,etc.However,since the crime of illegally absorbing public deposits and the crime of fund-raising fraud are two common crimes in judicial practice,and are also controversial in theory,this paper selects these two crimes for in-depth analysis.This paper first discusses the manifestations and causes of the excessive application of illegal fund-raising crimes,and then proposes that research should be conducted on the limitation of illegal fund-raising crimes,analyzes and explains the rationality of' the limitation,and finally puts forward some views and opinions on how to limit.Given the trend of expansion processing of illegal fund-raising crimes in judicial practice,this paper puts forward the view of research on the limitation of illegal fund--raising crimes,and discusses my own views and suggestions on the research of limitation from three aspects:the reasonable definition of "social public",the reasonable determination of the purpose of illegal possession and the reasonable deteramination of the active role of the victim's factors.Illegal fund-raising crime plays an important role in the field of financial crime.We should use the criminal law to regulate relevant financial crimes more reasonably,protect the legitimate rights and interests of small and medium-sized enterprises,and promote the healthy and stable development of our economy.
