Back in the 1970 s,the global community began to have a new understanding of cultural heritage and gradually protected it.Intangible cultural heritage(hereinafter referred to as “non-legacy”),as an inseparable part of cultural heritage,has also attracted widespread attention.As an ancient cultural country with a long history of 5,000 years,China has diverse customs and customs.The long history and culture have spawned a large number of intangible cultural heritage resources.These intangible cultural heritage resources contain rich cultural and economic values,which are sought after and favored by the market.The protection of intangible cultural heritage has evolved from a singular “static” protection to a“dynamic” developmental protection.This is the development path of intangible cultural heritage in line with the modern economy.However,with the deepening of the development and utilization of intangible cultural heritage,some problems have emerged.For example,the government has a value bias in the protection of intangible cultural heritage.As a “non-legacy” business entity,its inappropriate development and the lack of successor inheritance of the inheritors have curbed the development and protection of “non-legacy”.How to deal with the problems in the “non-legacy”protection work in essence is a common problem we face.Therefore,this paper studies the status quo and existing problems of intangible cultural heritage protection from the perspective of economic law.Put forward the path of economic law to protect intangible cultural heritage by discussing the realistic foundation and theoretical basis,and analyze the current status and experience of foreign intangible cultural heritage.It is concluded that economic law is the best way to protect intangible cultural heritage.Finally,the author attempts to construct an economic law protection path for intangible cultural heritage by regulating government intervention rights,transforming government functions,fiscal and taxation,finance,and unfair competition.In the research system,the full text is mainly composed of four parts.The first part is a basic overview of “non-legacy”.First of all,from the evolution of “non-legacy”,the origin of “non-legacy” is briefly described.Explain the concept of“non-legacy” from multiple angles,and clarify and deepen the understanding of the connotation of intangible cultural heritage.Finally,analyze the cultural and economic attributes of intangible cultural heritage and explain the relationship between the two.Deepen the understanding of intangible cultural heritage and introduce the possibility of government failure and market failure in protection.The second part analyzes the status quo of protection of intangible cultural heritage and economic law issues.First of all,the status quo of China's intangible cultural heritage protection is expounded from a macro perspective.Secondly,takingGuizhou as an example to analyze the protection status of China's intangible cultural heritage from the micro level.Through the analysis of the status quo,the problems existing in the protection of intangible cultural heritage in China are summarized,and the existing problems are analyzed by economic law to find out the root causes behind them,namely market failure and government failure.The third part is the analysis of the protection of economic law of intangible cultural heritage.Starting from the practical problems in the economic law to solve the protection of intangible cultural heritage,it discusses the advantages of economic law in the case of market and government failure.Further,the importance of economic law to the protection of “intangibles” is briefly described.On this basis,the theoretical basis of the protection of the economic law of intangible cultural heritage is explained by the theory of regional coordinated development of economic law and the theory of sustainable development.In this way,from the perspective of economic law,the protection of “non-legacy” is emphasized from both reality and theoretical basis.In-depth analysis of the existing measures of foreign “non-legacy” protection,summed up the protection experience that China can learn from.The fourth part is the path of economic law protection of intangible cultural heritage.Starting from solving two aspects of market failure and government failure,the economic law protection path of intangible cultural heritage is constructed by transforming government functions,regulating government intervention rights,market supervision,finance and taxation,finance,and unfair competition.To achieve the protection of intangible cultural heritage.
