As one of the four ancient civilizations in the world, China has a long history. Chinese culture is Colorful, broad and profound, and it is the cultural circle of East Asia culture protectorate. The 56 nations have a rich and colorful folk culture. The Chinese national intangible cultural heritage is a valuable wealth for later generations of ancestors. Intangible cultural heritage is intangible and public, determines that the government is in the leading position in the protection of intangible cultural heritage, which has not shirk the responsibility. In recent years, non-material cultural heritage protection and heritage issues have become increasingly prominent, which caused each country and society of the world, especially the social and cultural scholars attach great importance to, in the tide of the global protection and inheritance of non material cultural heritage, although the enthusiasm of China’s central government is very high, but the local government which takes the specific were measures do not become the backbone in the intangible cultural heritage protection and heritage effectively.The Majie temple fair is a a Han Chinese folk music event as the first included in state-level intangible cultural heritage list, and it has 700 years history. But because the government protection work started lately,and the government responsibility is not clear, Majie temple fair is facing the danger of extinction. Therefore, this paper chooses Majie temple fair as a case,which discusses through literature research method and empirical research method. This paper is divided into five parts. The first part of the article is about the research background, significance, research status and so on, and it puts forward some experts and scholars on the protection of intangible cultural heritage of the countermeasures and suggestions. The second part, through the analysis of the connotation and characteristics of the intangible cultural heritage, It is proved that the protection of intangible cultural heritage is valuable. And on this basis, from the empirical point, with the Majie temple fair as an example, introduces the general situation of Majie temple fair. In the third part, analysis the property of intangible cultural heritage, according to the appropriate government intervention theory and the concept of service-oriented government, combined with the relevant laws and regulations on the protection of intangible cultural heritage, put forward that the government should bear the responsibility. The fourth part,, combing and analysis the government in the protection of intangible cultural heritage of the policy in recent years, and analysis the problem and the reason that the government existing in the protection of Majie temple fair work. The fifth part, to solve the problem.and put forward by clear responsibility and the responsibility of the main boundary, construction of intangible cultural heritage, to establish effective protection and inheritance mechanism, increase government support, inheritance and innovation content and to attract the participation of social organizations and some suggestions, and strive to provide guidance for the government departments at all levels through the theory.
