Legislative Perfection Of Judge Assistant System Under The Background Of Judicial Reform

The establishment of the judge assistant system conforms to the modern judicial requirements,so that judges can effectively get rid of the interference of too many ancillary affairs in the past,and concentrate on the core business of the trial,which is in line with the general trend of building a society ruled by law.In this paper,the judicial reform in the context of the judicial system to improve the legislative study of the judge's assistant system,trying to explore the construction of China's national conditions of the judge's assistant system.In addition to the introduction and epilogue,this article is divided into 4 parts.The main contents are as follows:The first part analyzes the connotation of the judge assistant profession,further clarifies the important significance of the profession to our country's legal construction,and then reveals the necessity of establishing a modern assistant system.In the second part,through the comparative study of the judicial assistant system in foreign countries,especially in the western countries under the rule of law,the author seeks common characteristics and enlightenment,and provides some useful experiences and practices for the establishment of the judicial assistant system.The third part reveals the unavoidable prominent problems in the operation of the socialist judge assistant system with Chinese characteristics through the analysis and study of the operation of the socialist judge assistant system with Chinese characteristics.In the fourth part,through the study of the traditional Chinese judicial culture and the current judicial practice in China,the author puts forward a scientific and reasonable scheme to construct the socialist judge assistant system with Chinese characteristics.
