Research On The Right Of Reproduction Under The Cloud Computing Circumstance

The right of reproduction,as one of the core rights of copyright,is always developed with the relentless pace of science and technology.Recently,cloud computing,the burgeoning computer network technology and business model,has challenged the conventional concept of the reproduction right.Cloud computing has changed the pattern people utilize works from reproducing to experiencing directly,which causes malfunction of the reproduction right under the new circumstances.The problems brought by utilizing works during cloud computing,including the difficulty of identifying the infringer,the problem of applying rational utilization system,and the qualitative analysis of new reproduction patterns,are all the issues should be solved for refining the reproduction right.It becomes a significantproject in the field of Intellectual Property Law that how to protect the copyright owner by law,and how to keep the copyright owners' interests and the cloud computing service suppliers in balance.This article consists of four parts.The first chapter briefly summarizes the definition,characteristics and service modes.the second chapter includes viewing the conventional reproduction right and reproduction essential factors,proposing the influence of cloud computing on reproduction right,and analyzing the qualitative issue involving the reproduction while using the cloud computing.The third chapter proposes a series of infringement issues brought by the new ways of utilizing works according to the analysis of cases.The fourth one gives suggestions for refining the legislation of reproduction right as the foundation under the circumstances of cloud computing,to establish the Internet copyright protection mechanism centered on the right of communication in information network.Furthermore it also respectively proposes several legitimation suggestions involving the malfunction of reproduction right,the difficulty to identify the infringer,and the application of rational utilization system,which are caused by the SaaS model.
