Since the global financial crisis happened in 2008 had a serious impact on worldwide economics and at the same time the case “Heinrich Kieber” also happened in 2008 showed that the tax information could bring real and attractive economic benefits,the governments and international organizations have accelerated their paces to collect financial information from all over the world.So far,the development process has led to three modes of automatic exchange rules,which are the bilateral mode centered around the United States,the regional mode existing in the territory of EU and the multilateral mode promoted by OECD.Under the circumstance that the bilateral mode and the multilateral mode have functions together,it's surprising to find that the United States has obtained the most benefits,which means for non-US taxpayers,the United States will become a new tax haven.For this reason,a large amount of money began to flock to the United States.In view of this situation,this paper creatively applied country comparison research method to select and further analyze the domestic laws of offshore financial centers and non-EU member states,as well as the strategies taken by EU itself and its member-Luxembourg to fight with the United States.In the end,combining with the current situation of domestic legislation and international cooperation of our country-China,this paper analyzed the advantages and shortcomings of the “Administrative Measures for Due Diligence of Tax Related Information in respect of Non-Resident Financial Account(Draft for Comments)” issued by State Administration of Taxation,as well as other issues,in order to solve such issues.
