Personal Privacy Protection In Medical Big Data

Along with the rapid development of information technology,the era of big data is coming.The volume of data exerts explosive growth trend and the importance of data as the foundation of national strategic resources becomes more and more clear.However,the legal problems about personal privacy protection arises along with the development of big data,including medical personal privacy protection problems from the electronic medical records,and the resulting privacy risks in medical data sharing and mining.Our research is problem solving oriented and divided into four sections,try to make a discussion of personal privacy protection in the era of medical big data.The first section reviewed the legal source of the personal privacy protection,and discussed the present defections in medical privacy protection.This section analyzed the concept of medical big data,and concluded the medical personal privacy protection challenge.The connotation of medical personal privacy is discussed from multiple perspectives as physical privacy,health information privacy and personal space privacy.It was also revealed that the privacy became digital,valuable,and easy to leak.The definition of medical personal privacy was proposed and the domestic and international medical personal privacy protection cases were analyzed.The second section summarized the medical big data technology developments and medical personal privacy protection legislation of domestic and foreign countries.The third section summarized the survey result of patient privacy protection among 28 municipal hospitals about the perception of patient privacy protection,patient information usage and comments on current patient privacy protection status.Furthermore,case studies were applied to reveal the perceptions and intentions of patient and medical workers towards medical privacy protection.The survey samplings included 450 patients,335 medical workers and 237 medical information system manufacture staffs.The interview of lelgal specialist and government authorities was summarized,and the consensus was built that the current medical personal privacy was not safe and without a scientific legal system to regulate.The main difficulties on privacy protection were pointed out in this section.The fourth section analyzed the results of the investigation among municipal hospitals.It was concluded that medical staff,patients,andenterprises met the same connotation of medical big data,the synchronous protection consciousness,and the hospitals and enterprises must strength the execution and regulation of patient privacy protection.This section proposed legal,convenient,safe suggestions and exceptions for medical personal privacy protection,and indicated the critical points during the process of medical big data collection,management and application.A medical personal privacy protection risk control model was put forward.This essay firstly analyzed stakeholders as patients,medical institutions,functional government departments,authorized management institutions,and third party enterprises,and formed the privacy protection regulations by strengthening the institutions' self-discipline consciousness,improving the government administrative functions and establishing related legislation.
