The right of workers to resign is the right of workers to unilateral termination of labor contracts,which can be divided into two categories:the right of advance resignation and the right of immediate resignation.The right of resignation is a conditional right to form.workers can terminate unfavorable labor relations by exercising the right of resignation.They can also choose a new working environment to seek better development of themselves.As the current human resources market in China is still in the background of oversupply,in order to protect the interests of workers,the law gives workers the right to unilaterally terminate labor contracts has extremely important value and significance,which is not only conducive to the rational allocation of human resources,but also conducive to balancing the unequal relationship between labor and management.However,there are boundaries in the exercise of any right.With the continuous prosperity of socialist market economy in the past 40 years of reform and opening up,abuse of worker right to resign is common in practice.The emergence of new problems also shows that workers' right to resign still needs to be reasonably restricted.However,China's current labor legislation emphasizes too much on the inclined protection of workers,which to a certain extent results in the imbalance between the rights and interests of workers and employers.Therefore,it is necessary to make a thorough examination of the existing system of workers'right to resign.While protecting workers,the interests of workers and employers should reach a new balance,so as to achieve a harmonious and stable labor-capital relationship.Situation.It is of great value and significance to promote economic prosperity and optimize the allocation of labor resources.
