Some Thoughts On The Administrative Litigation Examination System Of College Students' Educational Management Behavior

The discussion on administrative litigation of college students' educational management in our country originated at the end of the 20 th century,but we have not carried on the systematic and in-depth administrative law research,which is related to theory and practice,and the legal status of colleges and universities.There is no unified conclusion on the legal relationship between colleges and students,the scope of administrative litigation and the intensity of examination.This not only damages the legitimate rights of students,but also damages judicial justice.From the perspective of judicial review,this paper focuses on the scope of accepting cases(which educational management behaviors of college students should be brought into administrative litigation)and the strong examination from two aspects: the scope of accepting cases(which educational management behaviors of college students should be brought into administrative litigation)and the strong examination.To study the administrative litigation examination system of college students' educational management behavior,the court should review the cases of college students' educational management.Specifically,the article is divided into three parts.The first part combs the relevant theoretical results at home and abroad for the administrative litigation of college students' education management,and on this basis,analyzes the legal status ofcolleges and universities in our country.The legal relationship between colleges and students lays a good theoretical foundation for the study of administrative litigation examination of students' educational management behavior in colleges and universities.The second part collates and sums up the cases in the field of student education management in colleges and universities,and finds out its problems.The third part is drawing lessons from developed countries.On the premise of the advanced ideas in this field,this paper puts forward some suggestions on the administrative litigation examination of the educational management behavior of college students in our country.In view of the scope of accepting the case,we should limit it to the basic rights and not only accept the cases that infringe on the students' right to receive education.It is also necessary to accept cases that infringe on students' property rights and other rights.For the intensity of the review,we should apply the principle of due process to the field of administration of colleges and universities on the basis of limited substantive review and comprehensive procedural review,and carry out a comprehensive and systematic review of the rules and regulations of the university.
