Research On The Understanding System Of Victims In China

In China,as one of the ways for people to settle disputes since ancient times,reconciliation has played an important role in maintaining social harmony and stability and promoting the development of social civilization.In life,people often reconcile with each other in private to settle disputes.However,this mode of solving problems directly by both sides of the contradiction has changed.After the establishment of the capitalist system,jurists and legislators began to pay attention to the rights of criminal defendants,thus,a series of legal systems aimed at protecting the rights of defendants.On the other hand,in order to fight against crimes and protect the legitimate rights and interests of citizens,a criminal justice system marked by state prosecution has been established.The state prosecution of criminal crimes plays a role in fighting crimes and.but it also ignores the legal status of victims in criminal cases.Thus,the rights of the victim,fade out to a certain extent from the center of the protection of rights.Which,the victim’s legal status should be paid attention to,the victim understanding system as an important issue to solve this problem,should be widely discussed.This paper is divided into six parts: the first part is the introduction,mainly about the research background and significance,research methods,innovation and research framework.The second part elaborates the relevant concepts,characteristics and significance of the application of the victim’s understanding system,and the victim’s understanding system should be paid enough attention in China.The third part is about the theory origin of the victim understanding system.This paper discusses the enlightenment of the theory of restorative justice,the theory of procedural subject and the system of criminal reconciliation on the understanding of victims in China.In the fourth part,the author discusses the current situation of the victim understanding system in China and the main problems in the victim understanding in China.The fifth part further discusses the causes of these problems.The sixth part is about the relevant ways to improve the victim understanding system in China.Mainly from the legislative,judicial and legal supervision system one by one analysis,hope to be able to help the development of the victim understanding system.
