Research On The Query System Of Real Estate Registration Information

Real estate registration inquiry system,also known as the "registration information disclosure system",always has been highly concerned about the community,but also the focus of the real estate registration system.The public is not only concerned about whether the real estate held by itself will be sought by any other person,but also pays great attention to whether they have the right to inquire about the real estate status of others.China's "property law" adopts a limited inquiry model,this limited openness can better protect the transaction security,but also alleviate the burden of registration institutions.In 2015 and 2016 it promulgated the "Provisional Regulations on real estate registration" "Provisional Regulations on real estate registration regulations",which improve the inquiry system of real estate registration as a supplement,more detailed provisions and more effectiveness.The current,the academic construction of real estate registration system from the system more theoretical level and technical level,but where in combination with the actual example,combined with "Internet +","big data analysis" and other mainstream technology,how to enhance and improve the information platform of functional and practical,how to implement the informatization construction of interdisciplinary,cross-regional,cross-sectoral,how to give full play to the registration information of the study also is less social comprehensive benefits,etc.Based on the existing theoretical results,this paper aims to study the real estate registration information,analyze the causes of these problems and put forward their own Suggestions.This paper proposed a court case study of some problems in current leads in the query process involved,and the inquiry system of real estate registration for general discussion,points out the characteristics and the value of the system and thelegislative status quo.Then,it is divided into 4 chapters from four aspects: query entity,query object,inquiry procedure and legal responsibility.The third chapter to the fifth chapter analyzes the subject,object and procedures of the query scope,legislative status,points out several issues currently exist,and then learn from foreign legislation and advanced system for comparative study,to further expand the query body,improve the property right management system and improve the query procedure of views and suggestions.The sixth chapter analyzes the legal liability of the subject of action from the angle of civil liability,administrative responsibility and criminal responsibility,and puts forward some legislative proposals on the real estate registration law and the personal information protection law.Finally,summarize the full text,in order to the current national pipelines of real estate registration system,construction of real estate registration information management platform help.
