Research On Legal Issues Of Real Estate Registration Information

Real estate registration information as the one which has the function of property rights of the public information,because the value of real estate is very big,the holder of the account for a relatively large share of the total assets,so we should pay attention to this part of information.Holder is to natural information voluntarily apply to the registration organ for registration of real estate,is for the sake of the creditor's rights of real estate after registration of the effect of real right,so the real estate registration information is made by the administrative department in accordance with the functions and powers belong to the government information,and at the same time as the holder of the real estate registration information inevitably contains personal privacy,so the real estate registration information at the same time contains the public rights and private rights.Therefore,the real estate registration information inquiry system needs to balance the right conflict between the property rights of publicity and transaction security and personal privacy protection.In this paper,it is believed that in the legislation of real estate registration information inquiry system,it should be allowed to query as the principle,because the protection of individual privacy and the appropriate limit is the exception.This article is divided into three parts,the first part from the connotation of the real estate registration information query,the query system of the stated purpose of real estate registration information query system are reviewed,which suggests that real estate registration information need professional query by government information,the real estate registration information query should account on open principles,in order to protect the privacy and limit the query to exception;The second part in the current world,several kinds of query mode based on the analysis of the existing query mode which accords with the situation of our country is put forward,and then through to our country existing involves the analysis of the real estate registration information query system,puts forward on March 2,2018 of the "interim measures for real estate registration data query" problems.The third part puts forward some Suggestions according to the existing problems of the existing real estate registration information inquiry system.This paper aim to through the research of real estate registration information query,make more subjects query to the more real estate registration information,in order to realize the function of the real right of the public and achieve the purpose of the protection of transaction security.
