Study On The Necessity Of Detention Censorship

For a long time,the high rate of detention?extended detention and long-term detention in China repeatedly criticized,which is considered to be a disease.The necessity of detention censorship established by the new criminal procedure law is referred to as the cure.The necessity of detention censorship since January 2013 formally implemented,has been more than four years,so the system exactly how efficacy,whether to play the functions of presupposition,whether effect a radical cure the disease or to actually improve disease,or could it turn to be the truth that the detention necessity examination system only seems beautiful but actually does not have much practical effect?To reflect objectively,the author selected the necessity of detention censorship in city's as research samples,starting from the current situation of the system,the existing problems from the analysis of reasons,and tries to put forward related suggestions,in the hope to make some contribution,if petty,to the improvement of this system with the author's contemplation.The full text is divided into four chapters: the first chapter according to the Procuratorial organs of TZ City to display the current TZ present situation and characteristics of the criminal detention measures applicable to data statistical analysis leads to the topic of this article namely need to review the current situation of low state of detention;the second chapter,on the basis of the above analysis of theProcuratorial organs of TZ City detained need review the reason for low state,from structure to catch,and one of such necessity to arrest rate is high and detention censorship itself the two lines,there are some drawbacks in view,the basic outline of the framework of the necessity to review of our current custody and short;the third chapter introduce the practice of pretrial detention of the main law countries outside the region with a view to improving the necessity of Chinese custody censorship;the fourth chapter is based on the short board and the active exploration of the necessity of the current custody of China,which is based on the foreword,and combines the advanced experience of the countries outside the region,and tries to make suggestions for improvement.
