Reserch On Financial Leasing Registration System In Shanghai Free-trade Zone

The legal basis of the financial leasing registration system originates from the public credit principle of the property law.To a great extent,the system plays a protective role for the development of the financing leasing industry.It also suffer great controversial in the framework of the specific rules of both the entity and the procedure.The guidanc issued by the General Office of the State Council on accelerating the development of financial leasing industry puts forward the development goal of "financing and leasing market scale and competitiveness ranking the top in the world by 2020”,at the same time,the Overall Plan of the China(Shanghai)Free-trade Zone was also enacted,which make the Shanghai Free-Trade Zone has become a gathering place for the financial leasing industry in China.In order to further promote the prosperity of the industry,it should be combined with the characteristics of the Shanghai Free-Trade Zone,while further clarifying the rights and legal effects of the registration system,and perfected from the four levels of application scope,registration organization,registration content and examination mode at the same time.From the angle of financing lease registration system,this paper tries to explore the perfect mode of financing lease registration system in the Shanghai Free Trade Area.This paper is composed of introduction,text and conclusion of three parts.The introduction starts with the background,the status of current study and the value ofthis thesis,then follows the classification and legal relationship of financing lease.The second part,the entity system of financing lease registration.Introduce the property of the right to register and the legal effect of the establishment of the registration system,Through the introduction of different theories and related systems abroad,I finally put forward the view that the author endorsed and supported,aiming at clarifying the fundamental role and purpose of establishing a financial leasing registration system in Shanghai Free-Trade Zone.The third part,the procedural system of financing lease registration,this part has the characteristics of practical base.This part specifically focus on the introduction of the four levels of registration object,registration institution,registration content and examination mode after the establishment of registration system.In the conclusion part,the legal effect of the registration system of financial leasing should be given.It is necessary to build the top level guarantee of the People's Republic of China Financial Leasing Law and the complete system design of the implementation rules of the Shanghai Free-Trade Zone.
