The ancient Chinese civilization has been inherited for thousands of years,and it is considered to be a heroic act of chivalry to help the brave and courageous,and has always been praised and respected by the mainstream morality.But,after doing righteous behavior,people often encounter various problems,such as medicine,work and life.During these recent years,being aware of the right sense of the people,there are more and more dissensions.Therefore,to praise and encourage the act of bravery from the moral point of view is not enough.We also need to protect the legitimate rights and interests of the brave.Only in this way can we advocate the action of the righteous.So,it is necessary to make a legal position on the act of brave.This paper will start with the basic concept of the brave.On this basis,it is considered that the national legislation must be carried out.This paper compares the relevant legislation of the domestic and foreign countries,and then points out the problems in the legislation and puts forward corresponding suggestions.Except the part of preface and epilogue,this article is divided into three parts:Preface elaborates on the background research,purpose,significance research method of this article.And the author will summarize the previous research,which play a great role in the completion of the article.The first part is the discussion and research on the status quo of the legislation.It points out the problems in the legislation.At present,there are some local laws and regulations in Chin,and the legislative level is uneven.There are different meanings in different regulations.This causes various problems.These laws and regulations are not enough for the regulation of the act of the righteous,and it is necessary to make the unified legislation for the brave.The second part is the research on the legislation of foreign countries.Because the relevant legislation of some foreign countries has been perfected.The legislative experience of these places can be used as a reference for China to formulate relevant laws and regulations suitable for the country.The third part is about four suggestions.The author puts forward four suggestions.First,we must unify the relevant content of the brave,and provide references for local legislation.Second,legislation must reflect state responsibility.Then,the legislation needs to improve the incentive compensation mechanism.Finally,the legislation needs to perfect the legal liability investigation mechanism.
