The Legal Thinking Of Righteous Behavior In Our Country

In recent years more and more regulations about righteous behavior have beenenacted. But, at present, regulations about righteous behavior in our country are notperfect. This paper is based on the analyses of the imperfect of the regulations aboutrighteous behavior in our country. In order to safeguard the rights and interests of thehero, and carry forward the traditional virtues of the Chinese Samaritan, this papergives the advice of establishing a long-term mechanism of safeguarding the rights andinterests of the Chinese Samaritan.The paper is divided into introduction, body and conclusion.The introduction introduces the background, research significance, researchmethods of the topic and the research status of righteous behavior at home andabroad.The body is divided into five chapters:The first part of this paper gives Samaritan law definition and constituentelements, by analyzing the domestic local regulations and foreign similar concept ofhero, which is the premise of the study’s Chinese Samaritan.The second part of this paper through a variety of analyses and comparisons ofthe theory draws my own point of view that a hero is both public and private lawnature of the hybrid nature of voluntary service, which is a special kind of voluntaryservice.The third part of this paper concretely analyzes the imperfect place of ourcountry’s heroic regulations, such as no unified to define; a lack of equality protection;a lack of strength, and the lack of state compensation obligation.The fourth part of this paper comparatively analyzes two big legal systems aboutthe Good Samaritan law provisions of the state. And we can see there are a lot of goodaspects worthy our using for reference, such as, the compensation liability of thecountry and the beneficiary.The fifth part gives suggestions to consummate our country regulations andestablish the long-term mechanism of hero. Through the unification of the uniform national legislation to speed up the behavior definition; To clear legal relief relationsof righteous behavior; To establish and improve the follow-protection mechanisms ofrighteous behavior; To establish and improve the indemnification mechanism ofrighteous behavior funds; To establish and improve the compensation mechanism ofrighteous behavior in our country.The last part of the paper is my conclusion.
