Study On The Countermeasures Of Professional Anti Fake Behavior In Food And Drug Safety Supervision

Since the 90 s of last century,professional counterfeiting people have gradually entered the field of vision of the masses.From the early focus on industrial product quality problems to the recent influx of food and drug safety supervision in the field,professional counterfeiters know how to buy fake and malicious complaints to the regulatory authorities for compensation,making grass-roots regulatory departments at a loss.Nowadays,the professional counterfeiters,as a special social supervision group to supervise and safeguard the rights of production and operation enterprises,which are produced by punitive damages and administrative rewards,are controversial.On the positive side,professional fake people can effectively protect consumers' rights and interests,and inspire consumers' awareness of rights protection.However,from a negative perspective,some professional counterfeiting not only disturbs the normal operation of economic order,but also wastes limited and tense administrative resources.Through the comprehensive use of case law,literature law,comparative law and empirical research methods,this paper takes the food complaints of grass-roots administrative supervision departments and the practical difficulties in investigating and dealing with the complaints of professional counterfeiters as the breakthrough point,and on the basis of the practical experience of foreign developed countries,it will standardize and guide food and drug products.In the product safety supervision,professional anti fake behavior is discussed.Finally,the administrative law enforcement departments how to deal with professional counterfeiters put forward opinions and suggestions,in order to promote food safety,improve the status of the industry,properly handle complaints and reports play a role.This paper puts emphasis on perfecting legislation and clarifying the application of relevant legal issues,regulating and guiding professional counterfeiters,promoting legal,smooth and rational complaints of professional counterfeiters,improving consumer awareness of safeguarding their rights,better regulating the role of professional counterfeiters in the supervision of food operators,and playing an auxiliary role in government supervision.
