A Research On Intellectual Property Protection Of Transit Goods In Hubei Free Trade Zone

On April 1st,2017,the China(Hubei)Free Trade Experimental Zone(referred to as the Hubei Free Trade Zone)was officially set up,which is a major measure to accelerate the rise of Central China and promote the development of the Yangtze River Economic Zone.In short,the Hubei Free Trade Zone has undertaken an important mission as a demonstration zone for the construction of the Yangtze River Economic Belt,a new highland for inland opening,a pilot zone for national innovation and reform,and a pilot zone for integration into a new round of economic globalization.However,accompanied by the historical mission of Hubei Free Trade Zone construction is its vulnerability in the protection of intellectual property rights.The Hubei Free Trade Zone belongs to the Free Trade Zone(FTZ)and essentially is a special economic zone carrying the functions of promoting international investment and trade,and its basic aim is to promote trade and stimulate economy.To ensure the liberation of trade,the tax services in the zone,the administrative approvals,and the import and export formalities,and customs supervision in the FTZ will be considerably simplified and relaxed.These facilitation measures will promote the development of trade while also providing an opportunity for the various intellectual property rights and criminal acts,which makes the FTZ a potential haven for IPR infringement.At present,the problem of IPR infringement in various countries is serious,especially of transit goods.With the continuous expansion and the in-depth and deep-going reforms of the FTZ pilot,the development of transit trade in the FTA has become more and more frequent.Associated with this is the issue of protection of intellectual property has become increasingly prominent.Therefore,it should not be blindly pursued in the FTZ to weaken the protection of IPR.However,strengthening the enforcement of intellectual property rights for goods in transit will inevitably hinder trade freedom in the free trade zone to a certain extent.Which is contrary to the principle of freedom of transit advocated by the WTO.In essence,the protection of IPR in transit goods in the Free Trade Zone is the collision and friction between different values of trade liberalization,facilitation and intellectual property protection.So,how to realize the balance between the two different value orientations is an urgent problem for the protection of intellectual property in the FTZ.In the future,so many free trade zones will be set up in China that the Reasonable and sound protection of intellectual property rights is an important guarantee for the healthy development of the free trade zone.The Hubei Free Trade Zone,as the frontier of reform and opening-up,should take the initiative to undertake all kinds of innovative pilot projects in the field of intellectual property in China.In the protection of IPR of the Hubei FTZ,it will explore more replicable construction experiences for the country,especially the inland free trade zones.This paper analyzes the regional characteristics of the FTZ in Hubei province and the problems it faces in the protection of the IPR of the goods in transit and puts forward some suggestions on perfecting the intellectual property protection of the transit goods in the Trade zone of Hubei province.
