Research On Competition Regulation System Of False Transactions

In economic activities,the temptation of interest always leads to misconduct of some market entities..While the Internet economy is promoting national development,social progress and the promotion of people's well-being,it also brought some bad things.Among them,the phenomenon of false transactions on the Internet is very prominent.This kind of false trading behavior to obtain competitive advantage by making up trading facts and thus to gain more economic benefits finally,as a matter of fact,is one new kind of unfair competition in the market.False transactions create an illusion of excessive prosperity in the online market,and can disrupt the competition order and infringe on the interests of consumers and other competitors,and erode the interests of society.The civil law and commercial law based on individual rights are not enough to regulate the proliferation of false transactions.However,the competition law which is based on social interests can use full of its characteristics of maintaining competition order to regulate this problem effectively.Therefore,this article studies false transactions from the perspective of competition and regulation,and hopes to provide advice and suggestions for purifying the network trading environment and maintaining normal competition.The body of this article consists of four chapters:The first chapter is the connotation and property of false transactions.This part mainly starts from the concept and type of false transactions and the legal attributes of false trading behaviors from different perspectives,and gives a basic introduction for the false trading behavior.The second chapter is about the necessity of the competition regulation system about the false transactions.This part mainly analyzes the reality basis of regulating false transactions in China,the limitations of civil and commercial law to regulate the false transactions,and the appropriateness of competition law to regulate false transactions.And we find the the harm of false transactions for market order,inter-operators and consumers.The third chapter is the legislative review of the competition regulation system about false transactions.This part mainly starts from the legislative status and the lack of legislation in the Competition Law,and analyzes the problems existing in the current legal regulation of false trading behavior.The fourth chapter is about the legislative proposals for the legal system of falsetransactions in China.This part mainly provides suggestions for perfecting the regulation of false transactions from the aspects of regulatory objects,behavior types and legal responsibilities on the shortcomings of the regulation about false transactions in the competition law.
