Research On China’s Network Pyramid Schemes Crime And Its Countermeasures

With the development of modern economy and society and the advancement of Internet technology,China has gradually entered the network era.The network brings not only new opportunities,but also new challenges.Traditional pyramid schemes have caught up with the express train of the Internet and have rapidly developed into a new type of network pyramid scheme crime.They have spread rapidly across the country and the world,becoming the "main force" of MLM positions,seriously endangering the social and economic order and the public’s property security and threatening social stability.In response to this problem,this article collected 217 valid cases of network pyramid crimes in the five years from January 1,2013 to December 31,2017 at Peking University’s magic treasure network,using data software for statistical analysis.On the basis of combining cases and literatures,this paper summarizes the current situation,typical forms and what gives a rise to the crimes of China’s cyber pyramid scheme crimes,suggests countermeasures against cyber pyramid scheme crimes.In addition to the introduction and conclusion,this article is divided into four chapters:Part 1:This part sorts out the development of MLM,and combines the definition of MLM in the current international community.According to the actual situation of China and the regulations of laws and regulations,it defines pyramid schemes and cyber pyramid schemes.On this basis,it summarizes the crimes of network pyramid schemes.The definition and analysis of the general characteristics and harmful consequences of network pyramid scheme crimes.Part 2:This part mainly analyzes the network pyramid sales cases published by Peking University’s magic net from 2013 to 2017.It summarizes the overall situation of China’s network pyramid selling crimes and analyzes the typical forms of China’s network marketing crimes.Part 3:This part analyzes the causes of China’s network pyramid scheme crimes from the social reasons of crime,the individual causes of the offenders and the causes of the victims,and thus conducts a more in-depth study on China’s network pyramid scheme crimes.Part 4:This part combines the actual situation of China’s network pyramid scheme crimes,and draws on some experiences and practices of foreign prevention and control network pyramid schemes,and discusses the countermeasures against network crimes in China from the perspectives of perfecting laws,strengthening law enforcement,publicity and education,and social participation.
