The Defects And Improvement Of Owner's Voting Rights

With the development of modern property management system,the protection of owners' rights has gradually been valued by people.Owner voting rights are an important owner's right,an important means for owners to exercise joint management rights,and an important guarantee for realizing owners' autonomy.However,there is still a gap in the theoretical circle and legislation on the research of the voting rights of the owners.The academic circles lack systematic research on a series of issues such as the concept,nature and formation basis of the voting rights of the owners.The current laws and regulations do not systematically stipulate the voting rights of the owners.There are obvious deficiencies in the design of the voting rights system of the owners.For example,the voting entities are not fully integrated with the actual situation,the resolution rules lack normative guarantees,and the owners' relief channels are not smooth.As a result,the voting rights of the owners are difficult in actual operation,which is not conducive to the guarantee of the joint management rights of the owners,thus affecting the realization of the autonomy of the owners.This paper starts with the basic theory of the voting rights of the owners,and clarifies the concept,nature,formation basis,content and characteristics of the voting rights of the owners,in order to grasp the voting rights of the owners as a whole.Later,from the two levels of legislation and practice,the status quo of the domestic voting rights system is reviewed.On the basis of sorting and summarizing,the third part of this paper summarizes the problems of the voting rights of the owners and analyzes the causes of the problems.Then,for the questions raised,the fourth part of this paper analyzes the foreign legislative experience and explores its reference significance.Finally,it puts forward relevant suggestions for improving the voting rights system of the owners.
