As an important part of the judicial process,judicial appraisal belongs to the type of evidence with strong probative ability.It has professional and scientific characteristics.This is also the source of the legality of the appraisal conclusion.Therefore,it must undergo legality review.The organ for review is the judiciary.And the judicial administration.The significance of the thesis research is to provide a reference for solving the dilemma of judicial review of judicial identification in administrative management and judicial activities through the ideas of public management.The research idea of this paper is to analyze the status quo of judicial identification and deeply analyze the dilemma and formation reasons of the legality review mechanism of judicial identification.Through the analysis of the judicial appraisal system,it explores its system defects,through the text analysis of relevant rules and regulations,understands the national policy norms,and discusses the unimproved places;through the data analysis of the legality review of judicial appraisal,explores its development trend in recent years.What are the dilemmas facing the situation;through the in-depth analysis of the case,explore the causes of the dilemma of legality review of judicial identification.Through interviews and other forms,we will explore the hurry.The main content of the thesis research is that there are three dilemmas in the legality review of judicial identification in China,that is,the dilemma of reviewing the scientific and professional insufficiency,the inconsistency of the standards of judicial appraisal institutions,and the contradiction between cost and rights.Through research and analysis of the causes of the formation of the dilemma,and put forward the idea of improvement,the first step is to establish a mechanism of expert assistants and multi-level judicial appraisal institutions in the context of the country's deepening of the reform of the country according to law.In the second step,the mechanism is reasonably embedded into the current legality review procedure,and the program design is deduced from the perspectives of the judicial appraisal management department and the judicial organs,with a view to providing reference for the design of the judicial review legality review system,and from the legality and reasonableness.The feasibility of the scheme is demonstrated by the perspectives of sex,operability and controllability.At the same time,through these studies,combined with the local actual situation,the design plan of the supporting scheme is proposed.
