First, the paper discussed the legality of the qualification for the civil servant’s recruitment examination, it sorted out the effective law regulations for that time through the administrative law introduction. Then it expounded the legality of the conditions for health, height, appearance, age and sex separately. In the writer’s view, for the recruitment of the police, the limits of the health, height, age conditions can be accepted; for the recruitment of the general civil servants, the limits of the age conditions can be accepted, but other limits are unlawful.Second, the paper discussed the unchargeable of the qualification for the civil servant’s recruitment examination, the chargeable of the rejection for the register, and enroll. The writer thinks that in the course of the recruitment for the civil servants, the conducts of the government’s administrative departments for the arrangement of the qualification is abstract and unchargeable; the conduct of rejection for register and enroll of the administration departments is concrete and chargeable.Last, the paper discussed the lawful investigation of the concrete recruitment and abstract administrative conduct in the hearing of the civil servants recruitment case. The writer thinks that the judicial investigation of the concrete recruitment action should adhere of the legal hearing principles. At the same time, the writer illustrates the thought of the lawful hearing for the concrete recruitment through the typical case. He briefly points out the necessity of the judicial investigation for the involvement of the abstract administrative conduct, the investigation mechanism, basis and ways.
