Investigation And Research On The Public Announcement Of Civil And Commercial Cases In The People's Court Of Area M

As a presumption and drafting service,service of public announcement is the value choice made by law after measuring fairness and efficiency.It is not only the equality of procedural rights of both parties,but also the timely decision of the court.Although the legislation stipulates the applicable conditions,modes and contents of public service,it also has the drawback of “carelessness”.However,the “carelessness”does not mean that “carelessness” is applied.In addition,the reasons for “difficulty in service” are becoming more and more complex,so that there are many problems or even “edge ball” in the application of public service in practice.In this paper,the M District People's Court civil and commercial announcement case(electronic)files as research samples,samples with diversity,complexity,typicality.Sample data are detailed and diverse.Sample analysis adopts the way of classification and comparison.It is shown intuitively and comprehensively in the form of charts and tables.With the words of “data”,it summarizes the problems and reasons in the application process of M District Court's announcement service,and puts forward operable suggestions.This paper is mainly divided into four parts: The first part is the introduction,which includes the reason,significance and domestic research status.The second part explains the basic background of the survey,namely the reasons for selecting the sample,the ideas and methods of the survey.The second part is about the performance of the announcement service from 2015 to 2017,that is,the survey sample and its sample analysis,and find out the problems and reasons.Mainly from the following perspectives,this paper makes a detailed and diverse comparison of the service of public announcements: the number and proportion of cases served by public announcements,the types and times of procedural documents issued by public announcements,the specific conditions of service before public announcements,the time of public announcements and the types of newspapers issued by public announcements,the status of the announceee,and the files and materials of public announcements.According to the sample and analysis,the following prominent problems are found in the announcement service of M District Court: inadequate start-up of announcement service,different review standards for application of announcement service,irregular process of announcement service,and inadequate control of announcement time nodes.This part closely combines the research data and cases to explain in detail and profoundly,with data,case description,showing the problems,more intuitively points out the problems in the application of announcement service process in M District Court,and combines the samples to analyze the subjective and objective reasons behind them.The third part,aiming at the problems existing in the service of announcement of M District Court,puts forward pertinent suggestions: 1.Establishing the examination and cooperation mechanism of service of announcement;2.Unifying the applicable standard of service of announcement;3.Perfecting the process specification of service of announcement;4.Accurately grasping the time node of announcement.Investigation found that the above problems and reasons,which belong to the M District Court “unique” problems are “different standards for the application of public announcement service review”,“inadequate control of the announcement time node”,and the corresponding recommendations are “unified standards for the application of public announcement service”,“accurate grasp of the announcement time node”.The other problems and reasons involved in the service of the announcement in the article,M District Court also has “special” points,which are explained and analyzed with samples and data.The problems and reasons of M District Court Announcement cases listed in this paper can almost be reflected and verified from the sample data.There are objective social,economic and other factors in the problem of announcement service of M District Court,but it also has its own unique reasons,especially the internal management mode and assessment criteria of the court,which have a profound impact on the application of announcement service.Therefore,in the background of not changing the current law,society,economy and other aspects,the M District Court can change and improve the relevant factors of public service from its own.
