Research On The Filing And Review System Of Normative Documents Of The Standing Committees Of Local People's Congresses In China

At present,it is an important period for the construction of socialist rule of law in China.The legislative system of "one yuan,two levels and multiple levels" has been established in China,and with the amendment of the legislative law of the People's Republic of China(hereinafter referred to as the legislative law)in 2015,the local legislative bodies have expanded from the previous "large cities" to "cities with districts",and the existence of diversified local legislative bodies is an indisputable fact.In the process of exercising local legislative power,it may be affected by various factors,such as the pursuit of maximization of local interests,which results in the deviation of local legislation from legitimate and reasonable requirements.However,the non-standard legislation will inevitably destroy the unity of our country's legal system and threaten the rights of citizens,so it is necessary to establish an effective local legislation supervision mechanism.The system of the standing committee of the local people's congress for the record is the main mechanism of local legislation supervision in China,but this system has not been established for a long time and is not mature in all aspects,so it has not achieved the expected effect in practice.This paper consists of three parts: introduction,main body and conclusion,and the main body is divided into four chapters: the first chapter mainly elaborates the related concepts of the normative document filing and review system of local people's congresses standing committee and the historical development of this system.Second,in the first chapter the basic theory of concepts such as basis,to the place National People's Congress standing committee of the normative documents for the record review system are discussed,and the significance of this system is to improve the system of the National People's Congress and the significance of strengthening the supervision of the people's congress(NPC)function,maintain the unity of legal system,to realize power balance protection administration according to law,protect the rights of citizens.Chapter three analyzes the problems existing in the review system of normative documents on the standing committee of local people's congresses,including the weak power of the review body,the uncertain scope and standards of review,the lack of a complete accountability mechanism,and the lack of a strong supervision mechanism.The fourth chapter puts forward the specific countermeasures to improve the regulatory document filing and review system of the standing committee of local people's congresses,which mainly include strengthening the capacity building of the examination institutions,clarifying the scope of examination,refining the examination standards,setting the appropriate legal responsibilities,and improving the filing,review and supervision mechanism(including the public participation mechanism and the open mechanism).
