The Standing Committees Of Local People's Congress's Research Towards The Record Review System Of Normative Documents

With the continuous advancement of the legal system in our country and the increasement of normative documents in number, the socialist legal system continues to improve. In order to ensure that the different level of legislative documents can comply with the requirement of the legal system, our country implements the legislative supervision system. The record review system is an important legislative supervision mode, which can ensure the effective operation of the legislative supervision system. "local organization law", "legislative law" and "supervision law" provides a guarantee for the establishment of the record review system of the Standing Committees of Local People's Congress, but in the review process, how to review inappropriate normative documents, "Supervision law" is not clearly defined, which authorities the Provincial People's Congress Standing Committee to make provision, with reference to "legislative law" on the legal origin of the normative documents for the record review procedures. The norms of existence developed by 31 Provincial People's Congress Standing Committee is not uniform. In order to maintain the unity of the legal system, which can ensure the Standing Committees of Local People's Congress to better carry out recording review, this paper mainly from three aspects of record, review and correction of the record review system, in order to improve the system.The first part of this paper is the introduction. Introduces the methods of writing this paper and research ideas, the innovation points, research background, domestic and foreign research summary and so on.The second part of this paper is an overview of the record review system of normative documents of the Standing Committees of Local People's Congress, which mainly introduces the object of the record review system, the concept and the function of the system. Based on two aspects of theoretical basis and legal basis, the paper analyzes the basis of the record review system, and finally discusses the function of the record review system: the unification of the legal system, the perfection of the supervision function and the protection of the people's interests.The third part of this paper mainly introduces the comparison between the record review system of normative documents of the Standing Committees of Local People's Congress and the western unconstitutional review system, and the connection between the record review system of normative documents of the Standing Committees of Local People's Congress and other legislative supervision system.The fourth part of this paper mainly introduces the current situation of the record review system of normative documents of the Standing Committees of Local People's Congress. This part analyses the 31 Provincial People's Congress Standing Committee's normative texts about recording review. At the same time, combined with the practice of the record review system, this part investigates the current problems of the system, inspections the current lack of the system.The fifth part of this paper is to improve legislation and work suggestions of the record review system of normative documents of the Standing Committees of Local People's Congress. From the legislative, institutional building and staffing, public participation mechanism and other aspects to improve.
