As a self-disciplined,non-profit association legal person,which is composed of the operators of the same industry and approved by law,trade associations naturally aim at safeguarding the common interests of the same industry.As the third way for the failure of government intervention and market failure,trade associations,on the one hand,are the link between market participants and the government.Through uploading and transmitting market information and government policies,they initiate self-discipline mechanism,formulate industry rules and regulations,regulate the business activities of their members,maintain market competition order and create a fair market trading environment.On the other hand,trade associations tend to restrict competition naturally.By organizing members of trade associations to reach and implement monopoly agreements,they can obtain high profits and consolidate their monopoly status by restricting competition in the form of fixed prices,market segmentation,production restriction and boycott.Compared with the monopoly agreement between individual operators,the monopoly agreement behavior of trade associations has higher stability,greater market destructiveness and deeper concealment.At the same time,due to the special historical background of the emergence and development of trade associations in China,their administrative color is relatively strong compared with foreign countries,and the industry distribution characteristics of monopoly agreement behavior of trade associations are more obvious.At present,China's legal regulations are still slightly inadequate.There are too many principled and declarative contents,but the concrete entities and procedural contents are lacking.This paper starts with the theory of monopoly agreements of industry associations,and analyzes the causes,behavior characteristics,necessity of regulation,specific forms of expression,and status quo of legal regulation.At the same time,through the quantitative analysis of relevant cases and qualitative analysis of typicalcases,this paper tries to summarize some laws of monopoly agreement behavior of trade associations and the shortcomings of legal regulation,In addition,some personal ideas are put forward in the light of the latest policies and measures promulgated by the state and the current changes.
