Trade Association Of China Anti-monopoly Law Regulation

It is not in recent years that trade association restricts competitionin China, it occurs in a more frequent and harmful way in recent years. In practice, trade association appears almost all the restrict competition cases, just like Shanghai gold and gems association fix price,Guangzhou glasses association boycott case, the noodle association of Chinese branch joint rising prices, and fuyang papermaking association make price monopoly,Zhongmou refrigeration association fix price etc. In view of such situation, China promulgated the anti-monopoly law in 2007. But it is just a broad, general sex regulation, which can not make a stipulation with clarity with conserving the limit competition behaviours of trade association and manager together. With this situation and the lack of our law,it is important and necessary to do a theoretical research about the Limiting competition behavior of trade association.Though the trade association is not the subject of market economy, but as the core subject - enterprise market consortium, the trade association plays a more and more important role in market competition. Trade associations can reduce provinces competitive cost and improve the efficiency of market competition, promote the market competition toward the direction of benign and healthy. But with its own characteristic limitations and industry interest drive, tradeassociation will implement some restrict competition behavior, and disturbing the order of market competition, and the competition environment of market, thus destroyed anti-monopoly law,and make it to be one of the focus of anti-monopoly law.This article use theoretical analysis and empirical analysis methods, follow the ideas of "why trade association will restrict competition behavior, the behaviour of trade associations restrict competition, the regulation of the restricts competitive behaviour,our country's current regulation status and how to perfect the idea ."The text contains three parts, the first part introduce the concept, characteristics,function,and the relationship with the competition of trade association,combining with some cases in practice,it is the functional characteristics and the dual role of trade association that decide its two sides: promote competition and restricts competition. In part two of this article, the author information exchange and standardized for example, to analysis the principle on regulation of restricts competitive behaviour of trade association. in the third part, the author summarizes the present legislation about trade association, then give its own ideas.
