Research Of Behavioral Remedy Measures For Concenration Of Undertakings

The conflict and balance between pursuit of concentration efficiency and anti-competitive effects brought by concentration of undertakings forced remedy measures.In two kinds of main remedy measures,behavioral remedy measures are deemed to be difficult to enforce and costs much,which does not get much attention and favor.However,in recent years,with the development of theory and accumulation of practice experience,the value and advantages of behavioral remedy measures are getting discovered slowly.Anti-monopoly enforcement agencies of some countries have improved the position of behavioral remedy measures in text,and Chinese Ministry of Commerce applies behavioral remedy measures often in practice and gives priority to them.Notwithstanding the Chinese Ministry of Commerce is getting more mature and regular in the application of behavioral remedy measures,there are still many deficiencies and the value of behavioral remedy measures has not been fully developed.Since China is lack of experience and accumulation in the application of behavioral remedy measures,it is necessary and meaningful to make an induction in theory and practice.Further,the lack of concrete norms and clear guidance leads to the randomness of practice in China.Therefore,the first step is to improve the system of norms,making every application of remedy measures well founded;then,it is necessary to conduct evaluation and get feedback from every case;in addition,arbitration mechanism of third party shall also be considered to reduce the cost of enforcement and improve the trustee system of behavioral remedy measures.
