The Research Of Resale Price Maintenance Agreement Of Legal Regulations In Chinese Automotive Industry

Resale price maintenance agreement is a typical way of vertical restraint,it's also a limit of products' price that upper executive to lower executive,and a contract that upper executive retain the price control.There are deviations in the law enforcement of antitrust agency to the automotive anti-monopoly because the obviously differences in different industry.For the reason that only one of illegal per se rules or reasonable rules can be selected in the law enforcement of automotive anti-monopoly,the thesis shows the opinion that the law enforcement agency of automotive anti-monopoly should promote law enforcement efficiency,the illegal per se rules,which is suitable for competitive conditions in China.Meanwhile,the thesis discusses disadvantages remain in Chinese automotive industry,and put forward plans according to the experience in the US and the EU.The thesis begins with the viewpoint that typical cases remain in automotive antimonopoly field in China,such as Benz antitrust case and SAIC general case,analyses relevant cases,then gets the problems that remain in automotive anti-monopoly field in China.The concept of resale price maintenance agreement are further analyzed in chapter3.Meanwhile,the effect of resale price maintenance agreement are not only limit competition but also adjust economy are found.The experience about automotive anti-monopoly field in the US and the EU are discussed in chapter4.The author discusses the controversy about the illegal per se rules and reasonable rules in the US and the illegal per se rules in the EU,and also analyses means of executing the law of automotive anti-monopoly in the US and the EU.Including improving automotive legislation,establishing principles of law enforcement and exemption system,the author discusses the advice in anti-monopoly field in China in the last chapter.
