Research On The Regulation Of Criminal Law Of "Soft Violence" Committed By Mafia-like Gangs

Mafia crimes has been long-standing problem,and it is a relatively mature behavior for the Mafia-like gangs to use “soft violence” to commit crimes.In essence,it will strengthen the social impact and external deterrence caused by “hard violence”,thus further strengthening the criminal capabilities of the Black Forces organization.At present,there is no expression of criminal forces in our criminal law,the development of evil forces and their “soft violence” is only exist in the normative documents.The “soft violence” in specific crimes is essentially a concept corresponding to “hard violence” of physical nature,and it is also a behavior which is different from the physical attack,and it can also cause the victim to panic and thus control the victim.In addition to the characteristics of traditional violence,the “soft violence” crimes has its own unique characteristics and attributes.The specific identification in judicial practice needs to distinguish “soft violence”between evil forces and Mafia-like gangs,and “soft violence” should be treated differently depending on the nature of the organization.On the one hand,“soft violence” is the judgment factor of the evil forces,on the other hand,it is also the composition of specific crimes.Because the level of the “soft violence” related issues of the evil forces are relatively low,the corresponding criminal law system is not perfect,so there are many problems in the application of specific judicial practice,and also the anti-reconnaissance ability of criminal organizations is becoming stronger,there is always a resurgence of defiance.Therefore,from the perspective of the criminal law regulations,clear provisions should be added to the criminal law,and the relevant crimes should be strictly defined,also the special criterias for “soft violence” should be highlighted.It is also possible to strengthen the judicial interpretation of the “soft violence”,in order to solve the problem of “soft violence” crimes against evil forces.
