With the rapid development of science and technology,the network represented by computer network and mobile telecommunication network gradually realizes integration,which greatly reduces the time and space constraints of implementing pyramid scheme crime.Traditional pyramid schemes have evolved into online pyramid schemes through the Internet,and they have become more and more arrogant under the protection of the Internet.Compared with traditional pyramid schemes,online marketing has shown a trend of professionalism and high academic qualifications,a more diversified form,a wide range of dissemination,and a more serious social harm.At present,China’s governance of online pyramid scheme crimes mainly inherits the traditional MLM governance model.In the judicial practice,the crime of "organization and leadership of pyramid schemes" is mostly regulated by network pyramid scheme crimes,but such crimes are still covered with various coats.Active throughout the country.In order to further crack down on network pyramid scheme crimes,purify cyberspace,and create a good market environment,it is necessary to analyze the problems existing in the current regulation of network pyramid scheme crimes.To explore the irrationalities of the corresponding laws in China,and put forward corresponding suggestions for improvement,in order to better punish the crime of online pyramid schemes.The full text contains four parts.Among them,the first part mainly introduces the concept of network marketing and related concepts,development process,crime characteristics and other aspects,and analyzes the corresponding laws and regulations,with a view to preliminary understanding of pyramid schemes.The second part focuses on the analysis of the network marketing activities mainly involve several crimes,and the comparison between crime and crime,which is more conducive to judicial practice.The third part comprehensively analyzes the problems existing in the current crackdown on network marketing activities from the legislative and judicial levels.If the threshold for entry is too high,the scope of attack is narrow.In the fourth aspect,in view of the problems existing in the regulation of network pyramid schemes in China,the specific suggestions on punishing the crime of network pyramid schemes are put forward from the legislative,judicial and preventive levels.
