Research On Liability For Compensation Of Compensation For Express Service

With the rise of online shopping business,people widely participate in online shopping,express delivery services so that people can get goods without leaving home to meet their daily needs,which has changed people's traditional way of life.It improves the efficiency and quality of people's life.However,with the rapid development of the express industry,the relevant supporting measures on the express industry in China have not been established and perfected,such as in the legislation,our country on the express service damage compensation related legislation is missing,and the existing laws and regulations have different levels of effectiveness;In the control of express delivery industry,the lack of management of express service companies,the quality of service of each express service company is uneven.This has led to continuous disputes over express services,a large number of damage to express services,the lack of effective supervision and perfect legislation,so that the legitimate rights and interests of shippers can not be protected.In practice,there are also cases in which the court leads to different judgments in the same case in the process of using discretion.In order to solve the problem of shipper's rights and interests damaged in express service damage compensation,this paper uses comparative analysis method,case analysis method and inductive analysis method to solve the controversial problems in the liability of express service damage compensation from the practice.For example,the legislative level of damage compensation for express service is low,the setting of exemption clause is unreasonable,the scope of compensation is not clear,the insurance system is not perfect,and the prompt rules of format clause are analyzed.At the same time,drawing lessons from the relevant systems of express service damage compensation liability in the United States,Germany,Australia and the United Kingdom,and proceeding from the current situation of China's express delivery industry,this paper puts forward some suggestions for further improving the express service damage compensation system in China.The aim is to safeguard the legitimate rights and interests of shippers and promote the healthy and orderly development of the express industry.
