A Comparative Study Of Chinese And American Cybersecurity Legislation

In recent years,with the rapid development and application of network information technology,the network security situation has become increasingly complex and severe.The Internet should run on the track of the rule of law.The rule of law in cyberspace is an important guarantee for cyber security.In response to the endless stream of cyber security issues,countries and international organizations around the world are actively taking measures.As a birthplace of Internet technology,the United States,with its highly developed information technology,has matured its legislation and policies in the field of network security,and has built a solid security barrier for its network information.The construction of China's network security legislation needs further improvement.Therefore,by comparing the Sino-US cyber security legislation,analyzing the differences between China and the US cyber security legislation,and drawing on the perfect experience of the United States,it is expected to help China's cyber security legislation construction and further promote the process of cyber security legislation in China.This paper mainly adopts a method of comparing research to conduct a comparative study on cyber security legislation between China and the United States.Firstly,it introduces the research background and significance of cyber security legislation,and combs the research status of domestic and foreign,and explains the research content of this paper.Secondly,it comprehensively interprets and explains the connotation and necessity of cyber security legislation.Then,compare and analyze about the current status of cyber security legislation between China and the United States,and introduce the cyber security legislation results,legislative system and legislative model of China and the United States respectively.On this basis,compare and analyze on the effectiveness and influence of legislation,the coordination of legal system,and the legislative thinking mode.After that,firstly,introduce The US network completed the principles of security legislation to analyzed and compared it.Then it introduced the main contents of China-US network security legislation,and elaborated and compared the three aspects of critical infrastructure protection,network security information sharing,monitoring and early warning and emergency response.Finally,on improving China's cyber security legislation,based on American experience and China's national conditions,it puts forward suggestions for improving the follow-up supporting legislation of the Network Security Law,improving the specific system of China's key infrastructure protection,and establishing China's cyber security information sharing system.
