The former staff faces serious discrimination in the employment of the former department,which is not conducive to the equal employment opportunities of the former staff.Only by paying attention to the equality of the former staff can effectively resolve social contradictions,maintain social stability and harmony,and promote the return of the former personnel to the society.Through the analysis of 600 front-time personnel,289 support workers,and sample surveys and interviews of employers and the public in Hunan Province,the paper analyzes the implementation of the equal employment rights guarantee for the former staff and analyzes the basic situation of the former staff.Factors such as employment status,employment rights protection,and the employer and the public to the employment acceptance of the former staff,found that the social security system for the former staff was not implemented,the employment placement mechanism for the former staff needed to be improved,and the employer's presence for the former staff Reasonable differential treatment,the general public has a problem of pre-existing discrimination against former subjects.By reading the relevant literature,studying the relevant jurisprudence of the Chinese refereeing document network,and combining with the relevant information on the employment of the former criminals in Hunan Province,it is found that the discrimination in employment of the former is caused by the following reasons.First,the current laws and regulations restrict the discriminatory provisions of equal employment of former personnel,including the prohibition on the equal employment of former personnel in the criminal law pre-existing reporting system and other laws,regulations and rules.Second,there is a lack of guarantee mechanism for equal employment rights of former personnel,including insufficient legal and policy operations and inadequate defensive provisions.Third,the concept of society affects the equal employment of former staff.Based on the current situation and the causes,the author puts forward relevant suggestions for guaranteeing the equal employment rights of our former criminals:Emphasis on the principle of combining restrictions and protection on the employment of former personnel.Specifically,it is improved from the following three aspects:First,modify or abolish the current laws and regulations to restrict the equal employment of former personnel:the establishment of a differential criminal law elimination system in the criminal law,and the revision of other laws and regulations on the unreasonable restrictions on the equal employment rights of former personnel.Second,establish a guarantee mechanism for equal employment rights of former personnel.At the legal level,the relevant provisions on anti-criminal discrimination,the specific safeguard measures for the implementation of the equal employment rights of the former staff,and the relief and improvement of the administrative and judicial remedies for the discrimination of the former employment are improved.Third,ereate a social environment for equal employment of former staff:improve the quality of the former staff,improve their ability to adapt to the society,increase the propaganda of the equal employment rights of the employers,implement their social responsibility commitments,and eliminate the public's commitment to the former staff.Discrimination.
