Research On The Legal Guarantee Mechanism Of The Credibility Of Local Government Statistical Data

With the advent of the information age,the role of data is becoming increasingly prominent,and the degree of attention is unprecedented,which is more important for the statistical science with data as the main carrier and results.Through the integration and analysis of data,statistical science can reflect the past and predict the future for economic society.Only when the statistics are true and accurate and accepted by the public can they have credibility,and vice versa.When the official statistics are known to the public through many data indicators such as per capita disposable income(pcdi),gross domestic product(GDP),consumer price index(CPI),it means that the government departments should make statistics according to law,facts and science to ensure that there is no risk.Unfortunately,due to the inherent defects of statistical work and the lack of relevant legal protection mechanism,all kinds of statistical fraud events have been exposed.In addition,statistical data and public perception are quite different,which leads to the credibility of statistical data in our country being constantly questioned by the public.The research of any subject needs to respond to the needs of social reality,and Chinese scholars have also made a lot of research on it,but the overall trend is to attach importance to statistical science and technology rather than legal system.The research on the direction of statistical science and technology is more detailed and in-depth,but in the field of statistical legal system,there are some abstract warning and advocacy research.Therefore,the research on the legal guarantee system of the credibility of local government statistical data has important theoretical value and practical significance.The first part: an overview of the credibility of local government statistical data.Firstly,the concept of credibility of local government statistical data is expounded.The credibility of local government statistical data refers to the degree to which the statistical data obtained and published in the performance of their duties by the statistical institutions established by the local people’s governments at or above the county level and the special statistical institutions of towns and townships are trusted and recognized by the public.Secondly,it discusses the influencing factors of the credibility of local government statistical data,including the quality of statistical data and the external performance of local government statistical institutions.Third,it discusses the role of the credibility of local government statistics,in order to clarify the significance of the legal protection system,including the impact on the credibility of the government,the smooth operation of statistical work and the use of statistical data.Finally,it discusses the necessity of the legal protection of the credibility of local government statistical data.Through the comparison of social moral system,private agreement system and legal system,it emphasizes that the construction of legal system is necessary to protect the credibility of local government statistical data.The second part,it analyzes the current situation of the credibility of statistical data in China and the reasons for the loss of credibility.According to the social survey,15.9% of the public approve the credibility of government statistics,50.8% of the public approve it,13.3% of the public disapprove it,and 20% of the public don’t know it.However,in terms of the recognition degree of specific statistical data,the recognition degree of all kinds of data is quite different,among which the recognition degree of census data is the highest,64.6% of which are recognized and basically recognized,and the recognition degree of industrial growth data above scale is the lowest,only 39% of which are recognized and basically recognized.The reasons for the dishonesty include system level and practice level.The former includes the imperfection of the statistical law,the defects of the statistical management system,the imperfection of the statistical disclosure system and the imperfection of the statistical dishonesty punishment system;the latter includes the lack of professionalism of the government statisticians,the rapid updating of statistical needs,the lack of public statistical awareness and the inadequate statistical supervision.The third part,from the perspective of comparative law,examines the legal guarantee system of the credibility of government statistical data in the United States and Germany,from which we can get the following enlightenment: first,in terms of the setting of government statistical system,although both countries have their own characteristics and choose the government statistical system suitable for their own national conditions,the two countries have a consensus on maintaining the independence of statistical institutions.Second,we should pay full attention to the development of statistical science and technology.Statistics is a science that keeps improving.Just like physical chemistry,it needs systematic input of resources and continuous innovation of existing statistical science and technology.Third,both countries have issued a large number of statistical legal documents,which are still improving.The fourth part,on the basis of the above research,puts forward specific measures to improve the legal guarantee mechanism of the credibility of local government statistical data.First,improve the basic statistical legal system.Including the improvement of Statistics Law,statistics open system and statistics agency system.Second,we need to improve the mechanism of government statistical supervision.Including improving the government statistical management system,improving the internal review mechanism and improving the public supervision mechanism at the same level.Third,we need to improve the legal punishment mechanism for statistical violations,focusing on improving the statistical law enforcement mechanism,improving the statistical dishonesty punishment mechanism and improving the administrative punishment mechanism.
