Research On Programming Rules And Tort Liability Of Automated Vehicle In The Framework Of Legal Ethic

With the rapid development of AI(artificial intelligence)and automation technology,automated vehicle will become more and more popular.But now only several cities of our country made guidelines about automated vehicle test and there is no law adopted in the range of whole country,which will lead to a situation that no law can be applied to define the tort of automated vehicle.Therefore,this paper will firstly analyze the programming rules of automated vehicle.Then this paper will make precise programming rules by making some different assumptions,which will provide basics for defining the tort liability of automated vehicle.This paper is going to discuss the problem about how to confirm the subject of tort liability in an automated vehicle traffic accident,the problem about how to allocate the liability and finally put forward suggestions about how to perfect the imputation principles due to the automated vehicle.Four parts consist of this paper.The first part is about programming rules of automated vehicle in the framework of legal ethic.This paper introduces that with the popularity of automated vehicle,the problem of legal ethic could not be ignored.This paper analyzes the basics of legal ethic and necessity of programming rules.Then this paper puts forward the programming rules of automated vehicle.The second part is about the relationship between programming rules and imputation principles of automated vehicle.The programming rules are the basics to confirm whether the side of motor vehicle is accountable.Only if the responsibility of motor vehicle is confirmed,can imputation procedure start.The third part is legal analysis of automated vehicle traffic accident tort liability.This paper firstly tends to discuss whether the artificial intelligence,especially automated vehicle,could be civil subject.Then it is going to give an opinion about the liability subject of automated vehicle traffic accident.Finally,the imputation principles of automated vehicle traffic accident will be discussed in the circumstance of the absence of vehicle driver.The fourth part is the supporting measures of automated vehicle traffic accident tort liability.This paper is going to analyze the supporting measures in the aspects of insurance system,installing driving recorder forcibly,driver qualification system and follow-up observation system.
