Study On Legal Regulation Of Internet-Medicine Operation

The Internet pharmaceutical industry has emerged with the rapid development of the e-commerce economy.Internet-operated medicines have the advantages of lower price,more variety,convenience,and are gradually being accepted by Chinese consumers.However,the rapid development of the Internet pharmaceutical industry has brought a series of problems,such as the illegal sale of prescription drugs and the sale of counterfeit and inferior drugs.These problems not only affect the reputation of drug operators and the health of consumers,but also seriously affect the order of drug management in China.By defining the meaning of Internet drug operation and its legal supervision,the research scope is clarified.Based on the analysis of the current status of China's Internet drug operation legal supervision,it is pointed out that China's Internet drug operation supervision legislation has low legislative levels,and it can't formed a complete legal system,and lacks regulatory content.The supervision mechanism has scattered and uncoordinated regulatory bodies.Lagging supervision technology,lack of supervision personnel,unreasonable procedures of regulation,and the accountability to the supervision department is unclear.On the basis of analyzing and summarizing the experience of the United States,Britain,Japan in the legal regulation of Internet drug operations,it is proposed that China's regulatory legislation should clarify the principles of supervision,improve market access standard,add and refine punishment methods and procedures,and clarify subjects and procedures for reviewing prescription drugs on the Internet,establishing a blacklist publicity system for which illegally operating drugs on the Internet,and adding special regulatory laws and regulations during major public health safety emergencies regulatory agencies,establish a legal regulatory mechanism coordinated by various departments,and clarify the regulatory responsibilities of the regulatory agencies.
